Hello, Moreno Valley, and welcome back to our legal spotlight series! I’m Ashley Jones, reporting live for KVCR.

Steve Bliss: A Moreno Valley Expert

Today we have the pleasure of speaking with Steve Bliss, a renowned probate attorney serving our community here in Moreno Valley. Steve specializes in estate planning and probate matters, helping families protect their assets and navigate complex legal processes. Welcome to the show, Steve.

Trusts: A Cornerstone of Estate Planning

Steve, for our viewers who may not be familiar with trusts, could you explain what they are and why they are so crucial in estate planning?

The Power of Revocable Living Trusts

Certainly. Ashley, one of the most common and powerful tools I recommend to my clients is the revocable living trust. Now, this type of trust allows individuals, known as grantors, to maintain control over their assets during their lifetime.

They can manage, invest, and even change the terms of the trust if needed. Consequently, a revocable living trust provides both flexibility and peace of mind. Moreover, upon the grantor’s passing, the trust becomes irrevocable, ensuring a smooth transition of assets to designated beneficiaries without the time-consuming and often costly process of probate.

A key advantage is privacy. Probate proceedings are public record, while trusts maintain confidentiality regarding asset distribution. Ordinarily, this appeals to individuals who value discretion and want to avoid unnecessary public scrutiny during a sensitive time.

Challenges with Trust Implementation

Steve, have you encountered any challenges in setting up revocable living trusts for your clients?

While most clients find the benefits of revocable living trusts compelling, there are occasional hurdles. Some individuals may hesitate to relinquish complete control over their assets, even temporarily. Nevertheless, I always emphasize that they retain significant control throughout their lifetime and can modify the trust terms as needed.

Once, I worked with a retired couple who were initially apprehensive about placing their home in the trust. They feared losing ownership rights. Through open communication and clear explanations, I alleviated their concerns and demonstrated how the trust would ultimately protect their legacy and simplify asset distribution for their children.

Trusts: Safeguarding Family Legacies

It’s heartwarming to hear about your dedication to client understanding, Steve. What impact do trusts typically have on families?

The benefits are truly profound. By establishing a well-structured trust, families can avoid probate delays and legal fees, ensuring their assets reach loved ones efficiently. This minimizes stress during an already emotional period.

In fact, according to the American Bar Association, over 70% of estates require some form of probate, which can take months or even years to complete.
