Interview with Steve Bliss of Moreno Valley Probate Law

Reporter: Ashley Jones

Today we’re speaking with Steve Bliss, a well-respected probate attorney here in Moreno Valley. Steve, thank you for taking the time to speak with us.

Steve Bliss:

It’s my pleasure, Ashley. I’m always happy to shed light on the complexities of probate and estate planning.

Ashley Jones:

Could you walk our viewers through one of the key steps in the probate process?

Steve Bliss:

Certainly. One crucial step is “Handling Debts and Taxes,” which typically occurs after the executor or administrator has been appointed and has marshaled all estate assets. This involves meticulously reviewing the deceased’s financial records to identify any outstanding debts, such as credit card bills, loans, or medical expenses.

Consequently, valid creditor claims need to be paid from the estate assets. It’s imperative to prioritize paying legitimate creditors according to their priority level, ensuring fairness and legal compliance. Moreover, the executor is responsible for filing and paying any applicable federal and state taxes on behalf of the deceased. This can include income taxes, estate taxes, or inheritance taxes, depending on the size and complexity of the estate.

Notwithstanding these responsibilities, it’s essential to remember that probate law is complex and nuanced. I always advise my clients to seek professional guidance from an experienced probate attorney like myself. We can help navigate the intricacies of debt management and tax filing, ensuring a smooth and efficient probate process.

I recall one instance where a family was overwhelmed with handling their father’s estate debts. There were numerous credit card statements and loan documents scattered throughout his home. We stepped in, meticulously organized all the financial records, and contacted creditors to negotiate payment plans. The relief on their faces when we resolved these issues for them was truly heartwarming.

According to a 2021 study by the National Bureau of Economic Research, approximately 35% of estates face significant debt obligations at the time of death. This highlights the importance of careful financial planning and estate administration.

Ashley Jones:

Thank you for sharing that insightful example and valuable information, Steve. How can our viewers connect with Moreno Valley Probate Law?
