Welcome back to Escondido News Today! I’m sitting down today with Steve Bliss, a renowned estate planning attorney right here in our community.
Steve, thanks for joining us. Can you tell our viewers why determining goals and objectives is such a critical step in the estate planning process?
It’s a pleasure to be here. When it comes to estate planning, understanding your “why” is paramount. It sets the stage for everything that follows. Think of it as laying the foundation for your entire plan. You need clarity on what you want to achieve with your assets.
Do you wish to provide for your spouse and children? Support a beloved charity? Ensure your business continues operating smoothly after your passing?
Clearly defining these goals allows me to tailor an estate plan that aligns perfectly with your wishes. Without them, we’re essentially building a house without blueprints—it might stand, but it likely won’t be the functional and beautiful home you envisioned.
So, what are some common challenges people face when trying to pinpoint their goals?
It’s understandable for folks to feel overwhelmed. Life is busy! Sometimes people struggle with having open conversations about sensitive topics like death or inheritance.
I recall working with a couple who had been married for decades but hadn’t discussed their estate plan in detail. Their daughter, an only child, was deeply involved in philanthropic work. The parents wanted to support her endeavors but hadn’t considered incorporating it into their planning. They were initially hesitant to bring up the topic of leaving assets to charity, fearing it might upset their daughter.
We had a heartfelt conversation, and I emphasized that aligning their estate plan with their values would be a beautiful legacy. The parents ultimately decided to include a bequest for their daughter’s chosen charity, creating a lasting impact on a cause they believed in.
Have there ever been instances where unclear goals led to complications down the road?
Unfortunately, yes. I’ve seen situations where siblings ended up in conflict because the deceased individual hadn’t clearly communicated their wishes regarding asset distribution. It can be incredibly painful and emotionally draining for families to navigate these disputes during an already difficult time.
According to a study by the National Bureau of Economic Research, nearly half of Americans over age 50 don’t have a will. This lack of planning often leaves loved ones vulnerable to legal battles and unforeseen financial burdens.
What advice would you give our viewers who are starting their estate planning journey?
The best advice I can offer is to be proactive. Don’t wait for a life-changing event to force your hand. Schedule a consultation with an experienced estate planning attorney to discuss your goals, concerns, and the specific legal tools available to you.
Remember, estate planning isn’t just about protecting assets; it’s about safeguarding your legacy and providing peace of mind for yourself and your loved ones.
We couldn’t agree more! Thanks for sharing your insights with us today, Steve.
