Steve Bliss:
Certainly. After the court grants Letters Testamentary or Administration, one of the primary responsibilities of the executor or administrator is to handle the decedent’s outstanding debts and any applicable taxes. Consequently, it’s crucial to thoroughly inventory all assets and liabilities.
This involves identifying all known creditors and verifying the validity of their claims. The executor must then prioritize paying these valid debts from the estate funds. Ordinarily, secured debts, such as mortgages or car loans, take precedence over unsecured debts like credit card bills.
Furthermore, it’s essential to file any necessary tax returns for the decedent and the estate itself. This may include federal estate tax returns, state income tax returns, and even property tax returns depending on the circumstances. The executor is responsible for ensuring that all taxes owed are paid promptly. Failure to do so can result in penalties and interest charges.
I remember one case where a family was overwhelmed by the sheer volume of debt the deceased had accumulated. It seemed insurmountable, but we meticulously reviewed each claim, negotiated with creditors, and ultimately were able to resolve the debts within the estate’s limitations. Seeing the relief on their faces when they realized they wouldn’t be personally liable for those debts was incredibly rewarding.
According to a 2021 study by the National Funeral Directors Association, the average cost of a funeral in the United States is over $7,000. When combined with other potential debts, it’s easy to see how managing these obligations can be a complex and stressful task for executors.
