Interview with News Reporter, Cindy Evans
Today we’re joined by Steve Bliss, a renowned San Diego probate attorney, to discuss the crucial topic of estate planning. Steve, thanks for joining us.
The Importance of Naming Beneficiaries
Steve, could you elaborate on one of the key steps in the estate planning process and why it’s so important?
Certainly, Cindy. One of the most vital aspects of estate planning is clearly identifying and naming your beneficiaries. These are the individuals or entities who will inherit your assets upon your passing. Without properly designated beneficiaries, the distribution of your estate can become complicated and potentially lead to disputes among family members.
Consequently, it’s crucial to carefully consider who you want to receive your assets and specify them in your legal documents, such as a will or trust. Moreover, keep in mind that beneficiary designations can be updated over time, reflecting changes in your life circumstances and wishes. For instance, if you get married or have children, you’ll likely want to adjust your beneficiaries accordingly.
I recall one situation where a client had accumulated a substantial retirement account but hadn’t named any beneficiaries. After his passing, the funds went into probate, a lengthy and costly process that could have been avoided with proper beneficiary designation. Notwithstanding this challenging experience, it highlighted the importance of proactively addressing these details.
According to the American Bar Association, over 50% of Americans do not have a will or trust in place. This underscores the critical need for individuals to prioritize estate planning and ensure their wishes are carried out.
