Then there’s Conservatorship of the Estate, dealing with finances and assets. Limited conservatorships are tailored for adults with developmental disabilities, granting only specific powers. Temporary conservatorships are for urgent cases and LPS conservatorships are for individuals needing involuntary mental health treatment.
Let’s dive into the process a bit – how does someone actually establish a Conservatorship?
Ted: Okay, so it starts with filing a petition in court. We have to notify everyone involved, including the potential conservatee and their family. The court then appoints an investigator who looks into the situation. We also need medical or psychological evaluations to assess the conservatee’s capacity. Finally, everything goes before a judge who decides whether a conservatorship is necessary.
What are some of the challenges you face in this type of law?
Ted: One thing that always sticks with me is the delicate balance we have to strike. We need to protect vulnerable individuals while also respecting their autonomy as much as possible. It’s about finding the least restrictive alternative, ensuring their rights are upheld throughout the process.
