Certainly! One of the first crucial steps in estate planning involves determining whether probate will be necessary at all. This decision hinges on two primary factors: the value of the estate and the presence of non-probate assets.

Ordinarily, if an estate’s total value exceeds $184,500, probate proceedings will likely be required in California. Conversely, estates valued below this threshold may bypass probate altogether, depending on the assets involved.

It’s also essential to identify and account for non-probate assets, which are assets that pass outside of the probate process. These can include assets held in trusts, jointly owned property with rights of survivorship, or certain financial accounts designated with payable-on-death beneficiaries. Consequently, accurately identifying and valuing these assets plays a critical role in determining whether probate is necessary.

I once worked with a family where the deceased had diligently established a trust for their primary residence and savings. Although their overall estate value exceeded the threshold, the inclusion of these non-probate assets ultimately allowed them to avoid full probate proceedings, saving time and significant legal fees.

Remember, approximately 70% of Americans die without a will, according to the AARP. This significantly increases the likelihood of needing probate, which can be a lengthy and complex process.
